SAGUACHE COUNTY—Saguache District Court Judge Martin Gonzales issued a “judgment” declaring the Center recall election valid, ordering that current trustees be removed and former contestees be rightfully seated.
In response to this judgment, issued after plaintiffs Moe Jones and Marilyn Marks filed a petition for rehearing Tuesday, the town of Center has filed a request that the court expedite its consideration of the petitions for rehearing “and immediately enter the mandate in this matter.”
The request for expedite reads: “Petitioners now seek to delay the matter even further by filing a petition for rehearing in this matter on Feb. 10…The recalled board of trustees has remained the governing body during the pendency of the court’s review and continues to take action including the expenditure of town funds and direction of town administration. Moreover, another election is scheduled on April 1 — only six weeks away — and petitioners wish to take their rightful positions in advance of the next election to alleviate voter confusion.
