Special prosecutor assigned in the case

ALAMOSA — Aaron and Adam Fresquez, the two brothers who have served as officers with the Center Police Department, are scheduled for dispositions in court on Dec. 18. Aaron Fresquez was CPD’s Chief of Police and Adam Fresquez was a CPD officer. 

The two men were both arrested in October on separate charges. 

According to documents received from the court, Aaron Fresquez is charged with one count of theft, a fifth-degree felony, for taking a thing of value (money) worth from $5,000 to $20,000. Fresquez is also charged with one count of first-degree official misconduct, a first-degree misdemeanor, for unlawfully and knowingly committing “an act relating to his office but constituting an unauthorized exercise of his official function.” 

Adam Fresquez is charged with one count of theft, a fifth-degree felony, also for taking between $5,000 and $20,000. 

Given the fact that both men were employed as law enforcement officers in her judicial district, District Attorney Anne Kelly requested the case be referred to a different judicial district with a special prosecutor assigned.  

The Valley Courier has learned that the case is being tried by a prosecutor named Vance Davis, who is an attorney with the 6th Judicial District in Durango. 

Both Adam and Aaron Fresquez were served a summons in the case and have not been booked into a detention center. As a result, no photos were currently available. 

The dispositions will be held in separate proceedings in the Saguache County Courthouse.
